Yes, the necessary provisions are contained in the SAFEM (FOP) Act, 1976, NDPS Act 1985 and PMLA 2002.
There is no fee for filing an appeal either under NDPS Act, 1985 or SAFEM (FOP) Act, 1976 ,however, a fee of Rs. 10000/- in the form of Demand Draft/Pay Order favouring Registrar, Appellate Tribunal, New Delhi is to be deposited for filing appeal under PMLA, 2002.
Yes, there is a time limit prescribed for filing appeal. Provisions of Section 68-O of the NDPS Act, 1985, Section 12 of SAFEM (FOP) Act, 1976 and Section 26 of PMLA 2002 may be referred to in this regard.
Yes, the forms for filing the appeal are prescribed under the following Rules:
- i. Prevention of Money Laundering (Appeal) Rules, 2005.
- ii. The Appellate Tribunal for Forfeited Property (Procedure) Rules 1989.
- iii. Appellate Tribunal for Forfeited Property (Procedure) Rules 1986.
The Headquarters of the Tribunal are located at Delhi. Appeals and Petition under the NDPS Act, 1985 and SAFEM (FOP) Act, 1976 may be heard at the Headquarters or at the discretion of the Chairman at Mumbai, Chennai, Kolkata, Allahabad or any other place.
