I want to file an appeal in Appellate Tribunal against the order of Competent Authority under SAFEM (FOP) Act, 1976 or under NDPS Act, 1985 or against the order of Adjudicating Authority under PMLA, 2002. Are there any Rules or Guidelines that I should follow?

Yes, the necessary provisions are contained in the SAFEM (FOP) Act, 1976, NDPS Act 1985 and PMLA 2002.

Is there any fee for filing an appeal under NDPS Act, 1985, SAFEM (FOP) Act, 1976 and PMLA, 2002?

There is no fee for filing an appeal either under NDPS Act, 1985 or SAFEM (FOP) Act, 1976 ,however, a fee of Rs. 10000/- in the form of Demand Draft/Pay Order favouring Registrar, Appellate Tribunal, New Delhi is to be deposited for filing appeal under PMLA, 2002.

Is there any limitation period regarding filing of appeal under NDPS Act, 1985, SAFEM (FOP) Act, 1976 and PMLA, 2002?

Yes, there is a time limit prescribed for filing appeal. Provisions of Section 68-O of the NDPS Act, 1985, Section 12 of SAFEM (FOP) Act, 1976 and Section 26 of PMLA 2002 may be referred to in this regard.

Are there any forms and formats prescribed in regard to the appeal being filed?

Yes, the forms for filing the appeal are prescribed under the following Rules:

i. Prevention of Money Laundering (Appeal) Rules, 2005.
ii. The Appellate Tribunal for Forfeited Property (Procedure) Rules 1989.
iii. Appellate Tribunal for Forfeited Property (Procedure) Rules 1986.

Is Appellate Tribunal having any other Bench?

The Headquarters of the Tribunal are located at Delhi. Appeals and Petition under the NDPS Act, 1985 and SAFEM (FOP) Act, 1976 may be heard at the Headquarters or at the discretion of the Chairman at Mumbai, Chennai, Kolkata, Allahabad or any other place.
